DATES OF CONTEST: The Saputo Cheese USA Inc. Frigo¨ Cheese Heads¨ "Build a Bright Future" Contest (the "Contest") starts at 12:00:01 AM Eastern Time ("ET") on August 1, 2016, and ends at 11:59:59 PM ET on October 31, 2016 (the "Contest Period"). The Contest Period is divided into a nomination period, a judging period and a voting period. The nomination period starts at 12:00:01 AM ET on August 1, 2016, and ends at 11:59:59 PM ET on September 30, 2016 (the "Nomination Period"). The judging period starts at 12:00:01 AM ET on October 1, 2016, and ends at 11:59:59 PM ET on October 16, 2016 (the "Judging Period"). The voting period starts at 12:00:01 AM ET on October 17, 2016, and ends at 11:59:59 PM ET on October 31, 2016 (the "Voting Period").
ELIGIBILITY: The School Awards (as defined below) will only be awarded to a state-accredited educational institution (grades kindergarten through 8th grade, public, private or parochial) (a "Designated School"). Entry is made on behalf of the Designated School named on the entry form. The Contest is open to all legal US residents physically residing in the 50 United States and District of Columbia who are at least 21 years of age or older at the time of entry (the "Nominators"). Nominators are providing an entry on behalf of their Designated School, and the Designated School selected will receive the School Award; no Nominator will receive a prize. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live; or persons living in same household, whether related or not) of Saputo Cheese USA Inc. (the "Sponsor"), its subsidiaries and affiliated companies, advertising and promotion agencies, and any other entities directly associated with this Contest, including National Geographic Partners, LLC (collectively, "Released Parties") are not eligible to participate, enter or win. Void in Puerto Rico, the US Virgin Islands, US Military installations in foreign countries and where prohibited or restricted by law. This Contest is limited to two (2) Entries (as defined below) per person during the Nomination Period. Nominators may nominate the same Designated School, or a different Designated School, in each Entry. All federal, state and local laws and regulations apply. Being awarded a prize in this Contest is contingent upon compliance with these Official Rules. Entries from anyone who has been a prize winner in any contest or sweepstakes sponsored by the Sponsor in the 12 months prior to the Contest Period start date are invalid.
HOW TO NOMINATE: To nominate your Designated School, log on to BrightFuturePromo.com (the "Website") to access the entry form during the Nomination Period; complete the entry form with all required information, including your name, mailing address (no PO boxes), email address, date of birth and the name, city and state of the Designated School; and write an original essay of 50 to 200 words (in English) describing how the Designated School could use $10,000 to build a bright future for its students (the "Essay"), and submit as instructed on-screen during the Nomination Period to receive one (1) entry into the Contest (an "Entry"). A thank you message will be displayed to confirm that your Entry was successfully sent. Nominators must complete the entire Entry form in order to successfully enter into the Contest. Nominators will receive an email acknowledging their Entry has been received and will receive a second email informing the Nominator whether the Entry has been either accepted into the Contest or rejected for non-compliance. Acceptance of an Entry only means that the Entry has been moderated for appropriateness. Entries may still be rejected or disqualified for non-compliance after acceptance. No other correspondence regarding Entries will be acknowledged or entered into with Nominators. Participation constitutes Nominator's full and unconditional agreement to and acceptance of these Official Rules.
In the case of disputes, Entries will be deemed made by the Authorized Account Holder (as defined below) of the email address submitted at the time of Entry. Incomplete Entries and Entries not complying with these Official Rules are subject to disqualification.
LIMIT: Nominators shall respect the following limit otherwise they may be disqualified: two (2) Entries per person during the Nomination Period. This limit shall apply even if an Entry is rejected for non-compliance. Sponsor reserves the right to void all Entries made through any robotic, automatic, mechanical, programmed or similar Entry duplication method and to disqualify any individual using such method. Nominators may not enter with multiple email addresses nor may Nominators use any other device or artifice to enter multiple times or as multiple Nominators. Any Nominator who attempts to enter with multiple email addresses under multiple identities or uses any device or artifice to register multiple times may be disqualified and his/her Designated School may also be disqualified and forfeit any School Award, in Sponsor's discretion.
ESSAY REQUIREMENTS: The Essay must be Nominator's own original work, executed solely by Nominator, must be in English and between 50 and 200 words in length. Modifying, enhancing or altering a third party's preexisting work does not qualify as Nominator's own work. By submitting an Entry, Nominator hereby warrants and represents that the Entry conforms to the Essay requirements set forth herein. Entries that do not comply with these Official Rules or that otherwise contain prohibited or inappropriate content, as determined by the Sponsor in its sole discretion, will be disqualified and will not be considered for the Contest. Sponsor reserves the right to, and may or may not monitor/screen Entries prior to posting them to the Website. By entering, Nominators acknowledge that Sponsor has no obligation to use or post any Entry submitted.
BY SUBMITTING AN ENTRY, NOMINATOR ACKNOWLEDGES THAT THE ENTRY MAY BE POSTED ON SPONSOR’S WEBSITE OR IN OTHER MEDIA AT SPONSOR'S DISCRETION. By submitting an Entry, Nominator agrees that his/her Entry is freely made and made without restriction and will not place Sponsor under any obligation, and that Sponsor is free to disclose or otherwise use the ideas without any compensation to the Nominator/Designated School. Nominators acknowledge that Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than Nominator. Submission of an Entry grants Sponsor and Released Parties an unlimited, worldwide, perpetual license and right to publish, use, modify, edit and publicly perform the Entry in any way, in any and all media, without limitation, and without consideration to the Nominator or the Designated School.
By submitting an Essay, Nominator warrants and represents that it: (a) is the Nominator’s original work; (b) has not been previously published; (c) has not won previous awards; (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) and that publication of the Essay via various media including on the Website, will not infringe on the rights of any third party. Nominator agrees to indemnify and hold harmless Sponsor and Released Parties from any claims to the contrary.
Essays cannot (a) be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, reference nudity or any materially dangerous activity; (b) promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (c) be obscene or offensive, endorse any form of hate or hate group; (d) contain or infringe trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, email addresses or street addresses; (e) contain copyrighted materials owned by others without permission; (f) contain materials embodying the names, or other indicia identifying any person, living or dead, without permission; or (g) suggest, or itself be in violation of any law.
By accepting a School Award, the Designated School (and the Nominator who has submitted the winning Entry) agrees that the winning Essay will be deemed a "Work Made For Hire" under the Copyright Laws of the United States, but if it cannot be so deemed, then such Designated School and Nominator agree to irrevocably assign and transfer to Sponsor all of his/her/their right, title and interest in and to the winning Essay, including, but not limited to, all copyright and trademark rights which they may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Such Designated School and Nominator also hereby waive in favor of Sponsor, all rights of "Droit Moral" or "Moral Rights of Authors" or any similar rights or principles of law that either may now or later have to the selected Essay. Sponsor reserves the right to alter, change or modify the selected Essay, in its sole discretion. Upon request of Sponsor, Nominator and/or an authorized representative of the Designated School shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the Essay and of the copyrights transferred and "Moral Rights of Authors" waived under these Official Rules. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor's rights, and Sponsor may at a later time request the assignment.
ESSAYS POSTED TO THE WEBSITE ARE NOT EDITED BY SPONSOR AND ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL NOMINATOR AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Nominators and/or Designated Schools. Judging and Finalist Selection: At the end of the Nomination Period, all Entries will be judged by an independent panel of judges selected by Sponsor based on the following judging criteria: (1) overall appeal (40%); (2) feasibility (40%) - whether the $10,000 can reasonably contribute to accomplishing the project described in the Entry, as determined by Sponsor; (3) creativity of the Entry (20%) (the "Judging Criteria"). The five (5) Entries with the highest total scores based on the Judging Criteria will be deemed the potential finalist Entries, subject to confirmation of eligibility (the "Finalist Entries"). In the event of a tie for the fifth finalist's place, a tie breaker will be based on the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed, to break the tie. If Sponsor is unable to make contact with the Designated School or if the Designated School as named in the Finalist Entry is unwilling or unable to accept the School Award as stated in these Official Rules, such Finalist Entry will be disqualified and the next highest scoring Entry will become a Finalist Entry, subject to Sponsor's sole discretion.
Public Voting and Winner Selection: During the Voting Period, all legal US residents physically residing in the 50 United States and District of Columbia who are at least 21 years of age or older at the time of voting will have the opportunity to vote for their favorite Finalist Entry taking into account the Judging Criteria by visiting the Website and following the on-screen instructions to register and vote for an Essay. Limit one (1) vote per person per day. Any use of robotic, macro, automatic, programmed, proxy votes or like voting methods will void all such votes, and Sponsor reserves the right to nullify any and all such votes and to disqualify from voting the responsible individual and the corresponding Nominator/Entry, in Sponsor's sole discretion. Any attempt by any voter, any Nominator and/or a Nominator's family/friends to vote more than the number of times authorized herein using multiple/different names, email addresses, identities, and/or any other fraudulent mechanism or method, as determined by Sponsor in its sole discretion, shall give Sponsor the right to void those votes and disqualify the Nominator and his/her Entry in its sole discretion. Nominators and/or Nominators' family/friends are prohibited from obtaining votes by any inappropriate means, including, but not limited to, offering prizes or other inducements to members of public, paying a third-party service to vote for or obtain votes for a particular Entry, collaborating with other individuals or groups to trade votes, utilizing paid media amplification, or otherwise acting in contravention of these Official Rules, as determined by Sponsor, in its sole discretion, and Sponsor reserves the right to nullify any and all such votes, and to disqualify the responsible Nominator and his/her Entry from the Contest. Votes sent from foreign IP addresses may be disqualified, in Sponsor's sole discretion. At the end of the Voting Period, the Designated School specified in the one (1) Finalist Entry with the most eligible votes will be the potential winner of a Winning School Award, (as defined below), subject to verification (the "Potential Winning Designated School"). The Potential Winning Designated School and the Nominator who submitted the corresponding winning finalist entry will be notified by telephone and/or email before December 30, 2016. The remaining four (4) Designated Schools will be the potential winners of a Runner-Up School Award (as defined below), subject to verification (the "Potential Runner-Up Designated School"). In the event of a tie for a School Award, the tie breaker will be based on the original score received by the Finalist Entry under the above Judging Criteria. In the event there is still a tie, the tie breaker will be based on the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed, to break the tie. Subject to Sponsor's sole discretion, should the Potential Winning Designated School be unwilling or unable to accept the School Award under the conditions stated in these Official Rules, the Potential Winning Designated School will be disqualified and the Finalist Entry with the next highest number of votes will be deemed the Potential Winning Designated School. In such an event, it will be up to Sponsor's sole discretion whether to award any remaining Runner-Up School Awards and to which Designated Schools.
PRIZES: Sponsor has provided five (5) School Awards to be awarded as described below (the "School Awards"):
SCHOOL AWARDS (5): Winning Designated School Award (1): The Winning Designated School will receive ten thousand dollars ($10,000 USD), awarded in the form of a check payable to the Designated School, to be used towards the cause or project described in the winning Essay; a National Geographic Emerging Explorer Live Show at the Winning Designated School (the “Visit”); a $1,500 credit to be used towards National Geographic books and educational materials from the National Geographic Kids Book Catalog (available online at NationalGeographic.com/books) awarded in the form of an online redemption code; and a one (1) year subscription to National Geographic Kids magazine for each student currently enrolled at the Winning Designated School as of December 30, 2016 (the "Winning School Award"). The winning Designated School must allow National Geographic to film the Visit and use filmed content to create a video to air on National Geographic's YouTube Channel for a consecutive six (6) month duration after the Visit. Visit will take place on dates designated by Sponsor and/or National Geographic Partners, in each of their sole discretion. Runner-Up Designated School Awards (4): Each Runner-Up Designated School will receive $2,500, awarded in the form of a check payable to the Designated School, to be used toward the cause or project described in the winning Essay ("Runner-Up School Award"). Prior to accepting a School Award on the Designated School’s behalf, the principal or other authorized representative of the Designated School must sign and return within fourteen (14) days of issuance any required documentation, including, but not limited to, an unmodified Affidavit of Eligibility and Liability Release and a Publicity Release (where permitted by law). Each Nominator must also sign and return within fourteen (14) days of issuance any required documentation, including but not limited to, an unmodified Publicity Release (where permitted by law).
AWARD RESTRICTIONS: Limit one (1) School Award per Designated School. By accepting a School Award, each Designated School and Nominator consents to the use of his/her/its name, photograph, quote(s), Essay, and/or likeness for advertising/publicity purposes in commerce and in any and all media worldwide without limitation or additional compensation, except where prohibited by law. School Awards are non-transferable. No School Award substitution or cash equivalent allowed except by the Sponsor who reserves the right to award a School Award of equal or greater value should a School Award (or any component thereof) become unavailable. If any School Award notification is returned as undeliverable, or if a Designated School cannot be contacted for any reason, or if an authorized representative of the Designated School fails to execute and return required documentation within the time frame specified, School Award may be forfeited. School Awards not won and claimed by eligible Designated Schools in accordance with the Official Rules will not be awarded and will remain the property of Sponsor. Sponsor is not responsible for any change of contact information of Nominators or Designated Schools. School Awards are subject to availability and other restrictions, including state, local, municipal, and federal laws and limitations that may apply. A School Award (or any portion thereof) may not be sold, traded, transferred, assigned, refunded or redeemed for cash, unless otherwise agreed by Sponsor. Any and all taxes on School Awards are the responsibility of the Designated School. Sponsor advises Potential Winning Designated Schools to seek independent tax counsel prior to accepting a School Award.
GENERAL RULES OF PARTICIPATION: This Contest is subject to all applicable federal, state, local and municipal laws. By participating, Nominators and their Designated Schools agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in the Contest or these Official Rules. Sponsor is not responsible for lost, late, misdirected, undeliverable or incomplete Entries.
Sponsor reserves the right to disqualify any Nominator that Sponsor determines, in its sole discretion, violates these Official Rules. Sponsor reserves the right, in its sole discretion, to cancel, terminate, suspend and/or modify the Contest, or any part of it, at any time, without notice, and to cancel, terminate, modify or suspend the Contest in whole or in part, at any time, without notice and award the School Awards using all non-suspect eligible Entries received as of the termination/suspension date, if any computer virus, tampering, fraud or any other cause beyond Sponsor's control, affects the integrity or proper conduct of the Contest.
In the event of a dispute regarding the identity of an individual who actually submitted an online Entry, the Entry will be deemed submitted by the Authorized Account Holder of the email account provided in the Entry form. "Authorized Account Holder" is defined as the natural person who is assigned to an email account by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Nominators who submit an Entry on behalf of a Potential Winning Designated School or Potential Runner-Up Designated School may be required to show proof of being the Authorized Account Holder.
If for any reason this Contest is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, technical error, human error, tampering, unauthorized intervention, fraud or other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and judge from those Entries received up to the cancellation/suspension date.
CAUTION: ANY ATTEMPT BY A PARTICIPANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
This Contest is void where prohibited by law.
NO LIABILITY: By entering, Nominators and Designated Schools agree to comply with all Official Rules, as stated, and to release Sponsor, its officers, employees and agencies from any and all loss, cost, damage and/or liability as a result of their participation in this Contest, as well as acceptance and/or usage of a School Award (including without limitation to claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). By participating, Nominators and Designated Schools agree to release, discharge, indemnify and hold harmless the Released Parties and each of their respective officers, directors, employees, representatives and agents from and against any claims made by a Designated School, Nominators, or any other third parties, related in any way to the operation of this Contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any School Award or participation in any Contest-related activity or participation in this Contest. All third-party trademarks are used herein for identification purposes only, and are the property of their respective owners. Information supplied by Nominators is used for the purpose of administering this Contest, and will not be sold or shared in any manner by Sponsor, or any third parties.
INTERNET LIMITATIONS OF LIABILITY: Sponsor is not responsible for: failures or malfunctions of computers, tablets, phones, phone lines or telephone or data transmission systems; interrupted or unavailable network, server or other connections; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or any technical problem, including but not limited to any injury or damage to any person's computer or other device related to or resulting from Contest participation.
FACEBOOK: This Contest is in no way sponsored, endorsed or administered by or associated with Facebook. All participants understand that they are providing information to the Sponsor and not to Facebook. Facebook is completely released of all liability by each participant in this Contest.
